Mr. Weldon was charged with possession of a Class B controlled substance with intent to distribute - subsequent offense, possession of a Class B controlled substance, discharging a firearm within 500 feet of a dwelling, carrying a firearm without a license, improper possession of ammunition, and two counts of conspiracy to violate drug laws. He was released on personal recognizance.
As of yesterday 19-year-old Jeffrey S. Pina Jr. of Vidal Avenue, East Falmouth—the site of the incident—had yet to be arraigned, but he was arrested last week for possession of cocaine to distribute, possession of a Class B controlled substance, discharging a firearm within 500 feet of a dwelling, conspiracy to violate drug laws, possession of a firearm while committing a felony, possession of ammunition of unlawful caliber, and improper storage of a firearm.
The initial report released Friday by the Falmouth Police Department stated that on Thursday, January 10, at 5:52 PM police responded to the Vidal Avenue house after receiving a report of gunshots, and later determined that a gun had been fired into the home three times.
The incident was not classified as a drive-by shooting or a random event.
Court reports stated that police arrived to find Mr. Claudio and Mr. Pina on the property and two bullet holes in a bay window. Both suspects said they were inside the home at the time of the shooting, according to court reports.
According to police, during site interviews Mr. Weldon claimed he was standing outside the home when two individuals approached the house, fired at him, then fled on foot. He described one of the suspects as a black male dressed in a hooded sweatshirt and a partial ski mask. The other was described as possibly Hispanic, and Mr. Weldon said one of the men also struck him in the face before fleeing.
Inconsistencies in the suspects’ statements and the alleged discovery of drug paraphernalia in the home led police to obtain and execute a search warrant. A baggie containing cocaine was discovered and seized in the search.
Lieutenant Brian L. Reid said the investigation was active and ongoing, and more suspects could be charged in connection with the incident.
Due to this arrest, several past criminal charges against Mr. Weldon will be reviewed during a motion hearing on January 24. Those charges include distribution of a Class B controlled substance and conspiracy to violate drug laws, the result of a January 2011 arrest in Falmouth; possession of a Class D controlled substance to distribute, committing a drug violation near a school/park, and conspiracy to violate drug laws, the result of a November 2011 arrest in Falmouth; and operating a motor vehicle after the right to operate had been suspended, trafficking in cocaine, conspiracy to violate drug laws, intimidation of a witness, possession of a firearm without an FID card, possession of a Class B controlled substance, distribution of a class B controlled substances, the result of multiple February 2012 arrests in Falmouth.
